Motivation: Paralleling my own transformation from a Platonist to a radical constructivist, mathematics education has been experiencing for more than a decade a movement that started in theoretical foundations mostly originating in von Glasersfeld's work, and then reached professional organizations, which have been leading extensive efforts to reform school mathematics according to constructivist principles. However, the theories espoused by the researchers are, as yet, too abstract to lend themselves readily to implementation in the classroom. N2 - Purpose: I define a (...) shared experiential language (SEL) for the constructivist teacher to embody in order to transform her practice congruently according to constructivist principles. While SEL is comprised of Neuro-Linguistic Programming (NLP) subjective experience distinctions, what "makes it tick" is the constructivist epistemology with its insight that for consistent understanding to happen, new knowledge has to attach to prior experiences in a process of co-construction. Throughout the paper, I elaborate and validate this insight by numerous examples. Practical implications: Utilizing SEL allows understanding of mathematics to be rooted in each student's individual sensory experiences, thus shifting the responsibility for success in mathematics from the students back to those who guide them in co-constructing knowledge. This, in turn, should allow everybody access to understanding and so it should no longer be socially acceptable to fail in mathematics. (shrink)

Rawls' main aim in A Theory of Justice is to provide a viable alternative to the utilitarianism which has dominated so much modern moral philosophy. Although philosophers have long recognised the difficulties in the way of acceptance of a utilitarian account of judgments of justice, they have often responded by seeking merely to reformulate the principle of utility. Other philosophers, with a juster appreciation of the seriousness of these difficulties, have been prepared to reject utilitarianism in all its guises, (...) but they have failed “to construct a workable and systematic moral conception to oppose it”. What is needed, beyond a powerful reaffirmation of the familiar objections to utilitarian accounts of justice, is the careful elaboration of a radically non-utilitarian theory of justice. This article is concerned with the concept of “informed consent” as applied both in biomedical research involving human subjects and in clinical medicine in general. The current crisis over the elaboration and interpretation of the concept will be examined, along with the broader question of whether “informed consent” is any longer meaningful or viable as a criterion for complex bioethical policy-making. Finally, I will attempt to sketch a prognosis for the concept in doctor-patient relations, even if it is only (...) wishful thinking. (shrink)

This volume, included in the recently established Library of Philosophy and Religion, devotes its primary attention to recent discussion within analytic philosophy concerning the challenge which determinism offers to the concept of freedom and, thereby, to Christian theism. Although the author does not argue that determinism has been established, he does conclude that it is an empirical proposal and may well represent the situation. He is prepared to fall back upon a libertarianism if necessary, but considers determinism at face value (...) in order to confront the most serious opposition to his proposed compatibilism. There may be a sufficient condition for all acts, which would be, thereby, a determinism. Young’s problem is to establish a compatibilism so that even if a sufficient condition for all acts does hold, man is still free and responsible, and a Christian theism could be preserved. He proceeds to analyze four types of sufficient condition: 1) some laws of logic are sufficient for all outcomes; 2) antecedent causal conditions account for all outcomes; 3) God’s infallible knowledge and His eternal nature are the sufficient conditions for whatever happens; 4) an omnipotent deity is the sufficient condition of all outcomes. Young then attempts to establish that a doctrine of freedom and responsibility is compatible with each of these conditions and, thereby, Christian theism is, to that extent, secured. He offers a very careful analysis of each alternative, considering the strongest claims of recent analysts, and still finds a doctrine of responsible freedom viable, analysed in terms of ability and power to act. In the course of his analysis he gives more attention than the skeptic usually offers to the content of the skeptic’s world, and what would be involved in its analysis of freedom, action, responsibility, and evil. The skeptic’s world offers more theoretical problems than the skeptic’s neglect of his own positive position and his confining of analysis to a critical role has usually acknowledged. Although one might not have expected it to arise in such quarters, it is now well established that analytic philosophy offers a well developed and complex elaboration of natural theology and philosophy of religion, and in the revival of natural theology in analytic circles this book deserves careful attention.—H.A.D. Tout au long de l’histoire de la Chine, les confucéens se sont opposés au contrôle rigoureux du gouvernement légiste et ont mis en garde contre les effets négatifs de l’intervention de l’État dans l’économie. Cela ne s’est toutefois pas traduit par l’approbation d’un régime de droits de propriété privée sans entraves. Du point de vue confucéen, l’État a l’obligation de garantir les conditions du bien-être matériel de base de la population et celle-ci est prioritaire sur la promotion du marché libre, (...) ce qui devrait inspirer un régime justifiable de droits de propriété. Historiquement, les confucéens ont plaidé pour l’abolition des monopoles d’État sur le sel et sur le fer sous la dynastie Han, tandis que le système du « champ de captage » chez Mencius a permis à l’État d’attribuer des terres sur des fondements égalitaires. Ces exemples montrent que l’objectif principal des penseurs confucéens n’est ni un contrôle absolu de l’État sur l’économie, ni une forme de marché libre, mais plutôt un mixte pour le bien-être de la population. De nos jours, une attention particulière est accordée aux valeurs confucéennes dans les régimes de droits de propriété en Asie de l’Est et elle semble inciter les États à redistribuer les ressources de façon égalitaire, par exemple sous la forme d’une portion importante de logements sociaux, à Singapour et à Hong Kong ou, dans le secteur agricole en Chine, de la renaissance moderne du système du « champ de captage » de Mencius sous Deng Xiaoping. Dans ces exemples, l’accès de la population à la terre et au logement sont les garanties de son bien-être matériel basique : c’est ce qui a été privilégié sur un marché immobilier libre (voire libertarien). Une valeur centrale pour la garantie du bien-être matériel de base était le fait Mencius et Confucius, qui considèrent la survie du peuple comme condition préalable nécessaire au bon fonctionnement de tout ordre étatique. Alors que l’idée selon laquelle le confucianisme s’oppose en fait aux droits de propriété privée est largement répandue, cet essai suggère que le confucianisme propose plutôt sa propre théorie de la propriété. Au lieu de contester les droits de propriété en tant que tels, il remet en question les conceptualisations européennes et américaines de ces droits. Fondamentalement, la théorie confucéenne de la propriété considère que les droits de propriété sont « particularistes » et relatifs à d’autres considérations sociales. Par conséquent, ces droits peuvent primer sur les droits individuels, si besoin est. Cette notion confucéenne de la propriété peut non seulement être considérée comme une alternative à la conception libérale occidentale de la propriété, mais elle peut également offrir un point de départ viable pour examiner une multitude de notions de droit façonnées dans un contexte international. S’éloigner d’une notion centrée sur l’Occident et prendre en compte d’autres théories, comme le confucianisme, peut s’avérer crucial non seulement pour l’État chinois dans l’élaboration de ses lois et de ses règlements, mais aussi pour la communauté internationale lors de la rédaction d’accords véritablement internationaux. We elaborate the kind of metaphysical, ontological arguments and positions put forth by Martin and Sugarman in several ways, in an attempt to clarify that it is the assumption of psychological and sociocultural entities as fixed ontological categories that makes psychological—sociocultural dualism problematic, not the necessary distinction it draws between sociocultural and psychological processes. In so doing, we develop an emergent, mutable metaphysics and ontology for psychological and sociocultural processes that emphasizes their dynamic interrelation. We then attempt to articulate and (...) defend a neorealist hermeneutics as a viable epistemological accompaniment to this dynamic, interactionist metaphysics, and to indicate its appropriateness to psychological inquiry in particular. What reasons and resources can Christian theology find for developing a panentheist position that is also able to engage with contemporary science? By taking its point of departure in basic human experiences, Christian theology can, even in a Trinitarian fashion, be developed as a way to understand God's presence in the world as a presence where the actual occurrences point towards God's own work. This point is especially related to the experience of love. Furthermore, God's presence can be understood as (...) sacramental in the Augustinian sense. Moreover, the contributions of the Danish philosopher of religion Knud E. Løgstrup on God's presence and transcendence, as well as Niels Henrik Gregersen's elaborations on deep incarnation. This paper argues that Marx’s critique of capitalism is not, as commonly believed, a critique of the “free market.” I argue that the “market” under capitalism should be understood as a three-fold market—for goods and services, for labor and for capital. I argue that Marx’s critique is essentially a critique of the latter two markets, and not the first. Hence theoretical space opens up for “market socialism.” I proceed to elaborate briefly what specific institutions might comprise an economically viable (...) socialism that would not be vulnerable to Marx’s critique. In our response, we clarify important theoretical differences between basic emotion and psychological construction approaches. We evaluate the empirical status of the basic emotion approach, addressing whether it requires brain localization, whether localization can be observed with better analytic tools, and whether evidence for basic emotions exists in other types of measures. We then revisit the issue of whether the key hypotheses of psychological construction are supported by our meta-analytic findings. The meta-problem of consciousness is framed as a route into investigating why there are problems in understanding consciousness by describing the mechanisms underpinning our tendency to describe consciousness as problematic, and the evolutionary origins of these mechanisms. This is framed as a means of uniting illusionists and realists toward a common goal, but this supposes that the only viable form of illusionism is what I call 'hard-wired' illusionism, under which phenomenal judgments are a direct product of natural selection. I (...) argue that, instead, 'soft-wired' illusionism is more plausible, where phenomenal judgments are seen to be cultural phenomena. Since the problem of consciousness arises from a flawed theory of consciousness, pointing out the mechanisms underlying expression of the theory and the historical origins of the theory will not suffice to tell us why the theory is problematic. As such, the meta-problem is exclusionary toward soft-wired illusionism. (shrink)

UNTIL RECENT YEARS moral traditions have not been an important topic for moral philosophy. With few exceptions, attention has been directed to the problem of moral justification, to the search for universal criteria for the assessment of moral beliefs or judgments regardless of their traditional provenance. Generally, philosophers aspire to formulate "the view from nowhere." Since the publication of Alasdair MacIntyre's After Virtue there has been a revival of interest in the concept of a living, moral tradition, especially among moral (...) philosophers concerned with the possibility of an ethics of virtue or character as a viable alternative to the ethics of principle or, say, to deontological, utilitarian, or contractarian ethics. We must observe here that in the three decades prior to 1981, some moral philosophers displayed similar concern with tradition, although terms other than "tradition" were used, for example, "forms of life," "ways of life," "moral practices," and "moral community." Rawls's conception of reflective equilibrium is also developed with an eye on the notion of tradition. Indeed, Rawls has been quite explicit about his tradition-oriented approach to moral theory: "What justifies a conception of justice is not its being true to an order antecedent to and given to us, but its congruence with our deeper understanding of ourselves and our aspirations, and our realization that, given our history and the traditions embedded in our public life, it is the most reasonable doctrine.". In this follow-up to the highly successful _Ethnography Unbound,_ Michael Burawoy and nine colleagues break the bounds of conventional sociology, to explore the mutual shaping of local struggles and global forces. In contrast to the lofty debates between radical theorists, these nine studies excavate the dynamics and histories of globalization by extending out from the concrete, everyday world. The authors were participant observers in diverse struggles over extending citizenship, medicalizing breast cancer, dumping toxic waste, privatizing nursing homes, the degradation of (...) work, the withdrawal of welfare rights, and the elaboration of body politics. From their insider vantage points, they show how groups negotiate, circumvent, challenge, and even re-create the complex global web that entangles them. Traversing continents and extending over three years, this collaborative research developed its own distinctive method of "grounded globalization" to grasp the evaporation of traditional workplaces, the dissolution of enclaved communities, and the fluidity of identities. From the first books published by Jean-Paul Sartre, it is possible to observe the criticism that the French author makes to the Western metaphysical tradition, directed specifically at philosophers of modernity. For example, L'imagination and L'Imaginaire are two texts dedicated to questioning “the great metaphysical systems”. Furthermore, in these early investigations, Sartre discovers a principle that would allow him to elabo- rate his work Being and nothingness. What is this principle? The main objective of this essay is to determine this (...) principle and its importance in the elaboration of Being and nothingness. In order to achieve this purpose, I will analyze Sartre's criticism of modern philosophers (Descartes and Hume) and his proposal to overcome what Sartre himself calls: the “naive metaphysics of the image” (1978, p. 9), which is nothing more than the fact of reifying the image. Purpose: To examine the role of reductionism in the theoretical development of modern physics -- more specifically, in the quest for a complete unification of physical theory -- from the perspective of radical constructivism (RC). Approach: Some central features of the impact of RC on philosophy of physics are pointed out: its position of scientific relativism, with important implications for the validation of scientific propositions; and the notion of sharing constructed knowledge among individual knowers and its consequences for science teaching. The issue of reductionism is then discussed with regard to (a) the hierarchical explanatory ordering of physical phenomena; (b) the idea of a "theory of everything" (TOE); and (c) some of its implications for the methodology and sociology of science. Findings: It is argued that the ontological status of the hierarchical structuring inherent in the sought-after TOE will depend on the individual knower's epistemic position concerning the notion of truth in science. In the relativist epistemology of RC, any true/false dichotomy of theories is without meaning. A hierarchical ordering is just one of many possible strategies that may be chosen for the construction of physical theories; and such a strategy may then be considered successful only to the extent that it yields a theory that is viable. Implications: The paper serves as an illustration of the impact of RC on the ongoing search in physics for a "final theory.". (shrink)

The geometric-probabilistic phenomenology currently in use is not adequate for describing the interplay between the chemical mechanism and the observed kinetic behaviour. Inspired by Castañeda (1966, 1968), Perry (1979) and Lewis (1979) showed that a specific variety of singular thoughts, thoughts about oneself “as oneself” – de se thoughts, as Lewis called them – raise special issues, and they advanced rival accounts. Their suggestive examples raise the problem of de se thought – to wit, how to characterize it so as to give an accurate account of the data, tracing its relations to singular thoughts in general. After rehearsing the main tenets of (...) two contrasting accounts – a Lewisian one and a Perrian one – in the first section of this paper, in the second I will present a proposal of my own, which is a specific elaboration of the Perrian account. In the first section I will indicate some weaknesses of Perry’s presentation of his view; the proposal I will articulate in the second overcomes them. I will conclude with a brief discussion of reasons for preferring one or another account, in particular regarding the issue of the communication of de se thoughts. (shrink)

Referring to the phenomenon of structural injustice resulting from unintended consequences of the combination of the actions of many people, Iris Marion Young claims for a new understanding of responsibility. She proposes what she calls a social connection model of responsibility which assigns responsibility to individuals also for participating in ongoing structural and social processes. To remedy structural injustice Young claims for collective action of various actors in society and assigns different degrees of responsibility depending on the agent’s position within (...) the structural process. However, although Young mentions power, privilege, interest, and collective ability as parameters influencing the degree of an actor’s responsibility to contribute to structural change she does not elaborate which responsibilities concern which groups in society. As we will outline in our contribution, we hold the tenet of subsidiarity to be a useful supplement to the conception of Iris Marion Young which would allow for assigning such responsibilities to different layers in society. However, since the tenet of subsidiarity is only a supple principle which does not distinguish between different kinds of duties, we propose to enrich the tenet of subsidiarity by the Kantian conception of perfect and imperfect duties. Thirty years ago, I elaborated on a position that could be seen as a compromise between an "extreme," symbol-based AI, and a "neurochemical reductionism" in AI. The present article recalls aspects of the espoused framework of schema theory that, it suggested, could provide a better bridge from human psychology to brain theory than that offered by the symbol systems of A. Newell and H. A. Simon.

It is generally thought that Carnap’s principle of tolerance cannot be integrated into a coherent overall conception of rationality. The doubts come from many sides, of which two are singled out. This paper argues that both are wrong, and that Carnapian rationality is a viable and perhaps quite interesting program for further development.

Duhem first expounds the holistic thesis, according to which an experimental test always involves several hypotheses, in articles dating from the 1890s. Poincaré's analysis of a recent experiment in optics provides the incentive, but Duhem generalizes this analysis and develops a highly original methodological position. He is led to reject inductivism. I will endeavor to show the crucial role history of science comes to play in the development of Duhem's holism.

In The Face of Emotions, which was Carroll Izard’s first major attempt at elaborating his differential emotions theory, he stated that the book “presents a theoretical framework for the study of emotions and their role in personality and interpersonal processes.” Yet, over the years, his contribution to personality theory has generally been overshadowed by the attention focused on his views on facial expressions and the structure of emotions. This article will begin with a brief overview of the DET perspective (...) on personality development. Then, it will examine how the DET framework can be used to organize recent findings from three lines of research on adult personality. It will conclude with suggestions for future research as well as some personal recollections. (shrink)

Summary The present paper constitutes an elaboration of a previous work by one of us which, among other things, proposed some modifications of Popper's tetradic schema. Here, in the first part, we consider critically and develop further these modifications and elaborate on methods which prove more satisfactory for the mapping of the problem solving processes in Physics. We also find the opportunity to make some comments on Physics and on its relation to Mathematics. In the second part, there is an (...) attempt to test the above ideas on the genesis and development of the Special Relativity Theory. In doing this, we concentrate mainly on Einstein's 1905 paper and try to explicitate its relation with the situation Physics found itself in that period as well as to clarify the epistemological status of Einstein's two postulates. In communities of inquiry, dialogue is central as both the means and the outcome of collective inquiry. Indeed, features of dialogue—including formulating and asking questions, developing hypotheses and explanations, and offering and requesting reasons—are often highlighted as playing a significant role in the quality of the dialogue that unfolds. We inquire further into the quality of dialogue by arguing that dialogue should enable the expansion of epistemic openness, rather than its contraction, and that this is especially important in multicultural communities (...) of inquiry to acknowledge the cultural, perspectival, and experiential differences that exist alongside of similarities as resources for dialogue. The purpose of this article is to highlight two discourse practices that exemplify the nature of discourse as social practice and can be used in communities of inquiry. Attending to these discourse practices may enable teachers and students to reflect upon dialogue as it unfolds. First, we situate ourselves in multicultural classrooms in British Columbia, Canada. Then we articulate three principles of communities of inquiry. Next we describe and exemplify two discourse practices: heteroglossic attunement and lexical awareness. When attended to by teachers and students, 1) heteroglossic attunement enables teachers and students to begin to identify, reflect upon, and discuss the voices and perspectives that are drawn upon as participants inquire together and 2) lexical awareness enables teachers and students to begin to identify their attributions of thinking and feeling to social actors and to recognize how naming social actors positions them in an evolving set of social relations. Rather than a neutral medium of communication, social speech and dialogue is inherently value laden. Attending closely to the discourse that constitutes dialogue in a community of inquiry is a significant pedagogical tool for both teachers and students to expand epistemic openness and make visible learning as it unfolds. Upshot: I propose a mathematical approach to the framework developed in Dodig-Crnkovic’s target article. It points to an important property of natural computation, called the multiplicity principle (MP), which allows the development of increasingly complex cognitive processes and knowledge. While local dynamics are classically computable, a consequence of the MP is that the global dynamics is not, thus raising the problem of developing more elaborate computations, perhaps with (...) the help of Turing oracles. One of the more intriguing figures of the first period of the Successors is Nicanor, the lieutenant and admiral of Cassander. He came into prominence when he assumed command of the Macedonian garrison at Athens, late in 319 B.c. After distinguishing himself there he took a fleet to the Bosporus, where with Antigonus' collaboration he won a decisive victory over Polyperchon's royal navy. Subsequently his aspirations became sufficiently lofty to threaten his patron's security, and Cassander took elaborate precautions to ensure (...) his arrest and condemnation. Nicanor was clearly a figure of considerable importance; yet no source even hints at his origins and family background. Can conjecture go any way to filling the gaps? (shrink)

This dissertation consists in a philosophically constructive engagement with two different critiques of the Buddhist epistemological tradition stemming from Dignaga and Dharmakirti . The tradition of Dignaga and Dharmakirti, which was particularly important to the development of pan-Indian canons of reasoned argumentation, may plausibly be characterized as foundationalist. The traditions that follow the epistemologists in deploying these canons of reasoning are often taken as coextensive with or definitive of "philosophy" in classical India. Against this current, the dissertation aims at retrieving (...) and sympathetically elaborating some voices of philosophical dissent from this tradition. ;Specifically, the dissertation considers two significant but understudied critiques of the Buddhist epistemologists. First is that of one of the orthodox Brahmanical schools, viz., Purva Mimam&dotbelow;sa, whose constitutive concern is with the interpretation and authority of the earliest Vedic literature. It is argued that the characteristically Mimam&dotbelow;sa doctrine of "intrinsic validity" is best understood as a critique of the Buddhist tradition of epistemology, and that the Mimam&dotbelow;sa doctrine is analogous to contemporary "reformed epistemology." More attention is given to the critique of epistemology advanced by another Buddhist, the Madhyamika philosopher Candrakirti . Unlike that of Mimam&dotbelow;sa, Candrakirti's arguments amount to a principled refusal of epistemology. It is argued that the logically distinct character of Candrakirti's arguments is best understood by characterizing them as transcendental arguments, with this characterization of Candrakirti's thought facilitating the resolution of what have long been exegetical difficulties in his work. This characterization is meant more generally to advance the idea that there can be principled refusals of epistemological discourse which, insofar as they are based in good reasons for refusing such discourse, deserve to be taken as properly philosophical alternatives to epistemology. Thus, the arguments of these premodern Indian philosophers are not only examined and explicated, but critically assessed, such that they might be seen as representing philosophical interlocutors whose voices can be brought to bear on issues of concern to contemporary philosophers of religion. On the one hand, there comes the realization of human hegemony over the whole world around: in the 20th century mankind not only began to conquer outer space, invented nuclear weapons, made many amazing discoveries but also shifted its attention to itself (...) or rather to the modification of itself. Transhumanist projects aim to strengthen human influence by transforming human beings into other, more powerful and viable forms of being. Such projects continues the project of human “deification.” On the other hand, acknowledging the onset of the new geological epoch of the Anthropocene, there comes the rejection of classical interpretations of the human. The categories of historicity, sociality and subjectivity are no longer so anthropocentric. In the opinion of the posthumanists, the project of the Vitruvian man has proven to be untenable in the present-day environment and is increasingly criticized. The reflection on the phenomenon of the human and his future refers to the concepts that explore not only human but also non-human. Very often we can find a synonymous understanding of transhumanism and posthumanism. Although these movements work with the same modern constructs and concepts but interpret them in a fundamentally different way. The discourse of transhumanism refers to the Cartesian opposition of the body and the mind. Despite the sacralization of technology and the desire to purify the posthuman from such seemingly permanent attributes of the living as aging and death, transhumanism in many ways continues the ideas of the Enlightenment. For posthumanists, the subject is nomadic and a kind of assembly of human, animal, digital, chimerical. Thus, in posthumanism the main maxim of humanism about the human as the highest value is rejected – the human ceases to be “the measure of all things.”. (shrink)

The perennial interest in psychoanalysis shows no signs of abating and the longevity of psychoanalytic theory is seen in the varied extensions and elaborations of Freudian thinking in the fields of neuroscience and cognitive theory. Nevertheless, the scientific standing of psychoanalysis has long been questioned and developments in the fields of the philosophy of science and psychology require a fresh assessment of the scientific standing of psychoanalysis. While there are a range of views on the topic of whether psychoanalysis is (...) in fact scientific, any satisfactory approach to understanding mind and behaviour requires an approach that is at once both philosophic and scientific. Accordingly, to even approach the question regarding the scientific nature of psychoanalysis, a foundation comprising a sophisticated conceptual and philosophical framework is required. _Purpose__._ The authors aim to reveal the peculiarity of comprehension of the human phenomenon in the process of referring to the text of "Observations on the Feeling of the Beautiful and Sublime" by the early Immanuel Kant, which is based on the critical rethinking of the Enlightenment position. A prerequisite for its substantial solution is addressing the problem of the place of the "Observations" in the evolution of Kant’s anthropological views. _Theoretical basis__._ Our view of Kant’s legacy is based upon (...) the conceptual positions of phenomenology, existentialism and hermeneutics. _Originality__._ We have proved that the anthropological interest was inherent in Kant already in the pre-critical stage of his work, as shown by the still underestimated treatise "Observation". The paper give arguments that this text highlights the main topics that will later be the subject of a detailed study of both Kant himself and philosophical anthropology of the 20th century. It is revealed that Kant overcomes the Enlightenment temptation to absolutize the power of human reason and emphasizes its limitations. The specified step is a necessary condition for him to comprehend the important role of the sensual-passionate component of human nature and to recognize the importance of the metaphysical nature of man. _Conclusions._ For us today, the pre-critical Kant appears as the developer of anthropological teaching, first presented in the treatise "Observations". Already at this stage, Kant demonstrates a holistic vision of human nature. In the process of creative evolution of the thinker, this treatise should be qualified as a kind of sketch of the future concentrated development of human nature, elaborated in the pages of "Anthropology" in 1798. The author gives a key place to the metaphysics of human nature, a vivid illustration of which is, in particular, the last paragraph of "Observations" dedicated to freedom. The conducted analysis provides sufficient grounds for qualifying this text as an outline of the anthropological basis of his doctrine of pure reason, the doctrine of metaphysics as the metaphysics of man, which, in turn, gives us the key to understanding "Anthropology" as his final text. In the past few years, medical practices surrounding the decision to resuscitate marginally viable newborns have received a fair amount of attention. Baroness Warnock, of the UK Nuffield Council on Bioethics, has recently suggested that Britain follow the recommended practice in Holland of setting a gestational age limit below which marginally viable newborns should not be routinely resuscitated, despite reported statistical probabilities of raw survival approaching twenty percent. In the US, a highly publicized case from Texas came to (...) a controversial legal conclusion, permitting physicians to disregard parental preference for palliative care and unilaterally initiate resuscitation when faced with the birth of an extremely premature baby. The paper aims to rectify the reception of Heidegger’s so-called “hermeneutic violence,” by addressing the under-investigated issue of its actual target and rationale. Since the publication of Kant and the Problem of Metaphysics, some of Heidegger’s contemporary readers, such as Cassirer, as well as more recent commentators, accused Heidegger of doing violence to Kant’s and other philosophers’ texts. I show how the rationale of Heidegger’s self-acknowledged violence becomes tenable in light of his personal notes on his Kant book, and of (...) several hermeneutic tenets from Being and Time. The violence at stake turns out to be a genuine method, involving the appropriation (Zueignen) and the elaboration (Ausarbeiten) of an interpreted text. Its target, I argue, is not the text itself, as it was often assumed, but its reception by a community or tradition. Thus, that violence may well instill interpretive conflict, yet its purpose is to salvage a text from a conventional and ossified reception, namely, from what Heidegger regards as the authoritarianism of idle talk (Gerede) in a philosophical milieu. Computational modeling of the macaque brain grounds hypotheses on the brain of LCA-m. Elaborations thereof provide a brain model for LCA-c. The Mirror System Hypothesis charts further steps via imitation and pantomime to protosign and protolanguage on the path to a "language-ready brain" in Homo sapiens, with the path to speech being indirect. The material poses new challenges for both experimentation and modeling.

Problem: Is Niklas Luhmann’s theory of social systems based on a constructivist or on a realist epistemology? Luhmann’s own elaborations seem to oscillate between both standpoints. Method: The argumentation provided in this article starts with a detailed reconstruction of Luhmann’s epistemology and of Luhmann’s criticism towards radical constructivism and then examines the consequences for a comparison of systems theory and (radical) constructivism. Results: Although Luhmann’s operative constructivism can be distinguished from radical constructivism, the differences are not considered fundamental. Luhmann’s epistemology (...) is clearly nearer to constructivism than to realism and it shares most of constructivism’s key concepts, such as self-referential logic, a strict relation between observer and observed, and the relativism of reality construction. Implications: Luhmann’s criticism of radical constructivism must be understood in the context of his sociological background. Most of his arguments against radical constructivism can be considered apprehensions of misleading interpretations of radical constructivism rather than of substantial criticism. They may help to clarify a radical constructivist epistemology. Is aesthetics a viable discipline? Berel Lang in Art and Inquiry admits that despite the efforts of philosophers like Aristotle and Kant aesthetics has little to show for itself in its "verbose career" and hence there is reason for genuine doubt about its viability. Why has the work of aesthetics been so futile? Although Lang does not state the matter this way, the method of the book discloses the answer and the need which Lang felt for having to write (...) the book: the verbose career of aesthetics accords to a lack of understanding of what the aesthetic moment itself is. Because that lack precludes a straight-forward differentiation of the aesthetic from the nonaesthetic moment, Lang chooses a transcendental approach, beginning with an analysis of talk about art—namely, criticism—and disclosing by means of that analysis the object about which criticism purports to be. If we understand criticism, we have a possible answer to the question what is art. This answer is a possible, perhaps a probable one, Lang asserts, though certainly not a necessary one. For a final answer must transcend aesthetics. The categories which demarcate the aesthetic and non-aesthetic moments are metaphysical ones whose final test lies outside of aesthetics. (shrink)

I shall argue that the central doctrines of Locke's politics have a theological basis, a doctrine of Creation similar to the Thomist one. Locke does not elaborate this doctrine; he presupposes it. It is not a hidden, esoteric element in his thought; it is there on the surface, but in a scattered and fragmentary form.I shall proceed in this fashion: First, I shall set out this doctrine of Creation and show its connexion with Locke's moral theory by way of an (...) examination of his doctrines of property and power. Decisions to provide life-sustaining medical care for marginally viable newborns present a unique set of morally complex challenges for providers and parents in the United States. This article examines recent legal trends that restrict discretionary decision-making, and critiques commonly employed ethical justifications offered to support permitting such discretion.
